A History of Commitment to California's Injured Workers
Our firm was founded in Gilroy, California in 1992 by Attorneys Richard Robbins and Debra Pearlman Strunk. From the beginning, the primary focus of the Law Office of Robbins and Strunk was protecting the rights of employees with work-related injuries, and that remains our commitment to this day. In 2015, Attorney Christopher Cramer joined the firm, bringing with him over ten years of legal experience, and our name changed to Robbins, Strunk & Cramer. After the retirement of our founding partners and the recent addition of Attorney Raul Martinez to our team in 2020, we continue to provide the same level of exceptional service that our clients have come to expect, under our current name: Cramer & Martinez, LLP.
When you hire us for your workers' compensation case, you can expect personal attention from our attorneys as well as from our dedicated staff, some of whom have been with the firm since nearly the beginning. We pledge to treat you with compassion and to listen to your needs and concerns. We will be your guide and advocate until your case is resolved, and we charge no upfront fees or payment of any kind unless you are granted benefits.
Comprehensive Legal Services For Your Workers' Comp Claim
We assist with all stages of the process of filing a workers' compensation claim and obtaining benefits. Some of the ways we can help include:
- Guiding you through your initial claim. If you are unsure how to proceed after yourwork-related injuryorillness, we will advise you on the best course of action and help you notify your employer and submit your claim form in a timely manner. We can also help you understand the process of obtaining initialmedical careand advise you on the choice of your primary treating physician.
- Resolving disagreements with your primary treating physician. Your primary treating physician is responsible for recommending a course of medical treatment and submitting reports to your employer's claims administrator regarding your condition and work restrictions, which can significantly impact the benefits you are granted. If you disagree with the opinions of your doctor, you have the right to request a change or seek another opinion from a Qualified Medical Evaluator (QME), and we can help you take the necessary steps to do so.
- Ensuring timely payment of benefits. If your claim is accepted, your employer should pay your medical bills directly, and if you are awarded disability benefits, your employer should pay them every two weeks for the designated duration. If you believe you have received a medical bill in error, or if your disability payment is late, we will work to resolve the situation with the claims administrator and ensure that they are held accountable with a late payment penalty whenever appropriate.
- Representing you in the appeal process. If the claims administrator denies your initial claim, we will help you begin the appeal process by filing the necessary documents with the California Division of Workers' Compensation. We will also help you gather evidence of your condition and how your work has contributed to it, and represent you in a hearing with a workers' compensation judge, a mandatory settlement conference with the claims administrator, and a trial if necessary.
- Protecting you from discrimination. Under California law, employers are prohibited from terminating or otherwise discriminating against an employee who files or plans to file a workers' compensation claim. Workers who have been awarded benefits and those who testify in another employee's workers' compensation case are also protected. If you believe you have been the victim of discrimination, we can help you take legal action against your employer.
